EchoStar Communications has won a court ruling in the TiVo Inc. v. EchoStar Communications Corp. lawsuit that allows the company to continue selling digital video recorders while it appeals rival TiVo Inc.'s victory in a patent case. "We are pleased the Federal Court found that EchoStar has a 'substantial case on the merits' and blocked the Texas decision for the duration of the appeal. This action by the Federal Court reinforces our belief that the Texas court made significant errors during the trial process and we look forward to complete vindication of our position," read a statement from the company. "As a result of the Court action, our customers will not be disrupted and all of our DVR models will continue to be available through the EchoStar distribution system." TiVo won a trial in Texas, where it accused EchoStar of infringing a patent on so-called time-warp technology that lets users record one programme while watching another.

Roberts: Trouble foretold
Six months ago, an out-of-state minister known for prophecy told Oral Roberts University President Richard Roberts he would go through a "major storm" but would come through it. The minister also said, "When you enter your 60th year, you'll step to a new level of ministry you've never known," Roberts recalled in an interview with the Tulsa World. Roberts celebrated his 59th birthday on Monday and then began his 60th year, six weeks after three former ORU professors filed a lawsuit claiming wrongful termination and alleging the Roberts family has misused ORU and Oral Roberts Ministries money and resources for themselves. Nevertheless, through headphones (in English or Spanish) and photography, you will learn all about this child and his life in a land where AIDS is commonplace, and where children and their parents die at an early age.Called "Step Into Africa Experience," the audio tour is produced by World Vision, a Christian humanitarian organization dedicated to working with children, families and their communities worldwide to help them reach their full potential and tackling the causes of poverty and injustice, according to World Vision.Some 300 people from the Lodi area have already volunteered at least one four-hour shift to help organize the event, which will be held from Thursday through Monday, said Glen Barnes, an associate pastor at First Baptist, who is in charge of the Lodi effort.
Senior Olympics draw new friends to center
The competition wasn't too fierce among the participants, who meet most weekdays at the center. There, they socialize, play games and share lunch. "It's good for them to make new friends," said Jessica Medina, 17, who volunteered to help with this week's games. Medina is a student at the center who takes classes to earn a GED. The brightly painted center at the corners of Ocotillo Road and 54th Avenue in downtown Glendale has become a gathering place for all ages. It's where seniors gather each morning and where students like Medina take classes. Schoolchildren head there after school and teens hang out in the evenings. Julia Aguilera sank 15 shots in one minute. Asked if she ever played on a basketball team, the 68-year-old replied, "Not yet." That spunky attitude made the Glendale woman a two-time gold-medal winner.

Daschle on Obama’s appeal: Hope versus fear
Blah, blah, blah. Never a substantive complaint about how he might personally suffer if the Democrats assume control. Tuesday night he called for a long visit and it became apparent he has had an epiphany. He suddenly realized that his greatest prosperity came during the Clinton years and that his seven figure pension was lost and his company bought out by an uncaring competitor because of rules changes initiated during the GWB presidency. He has voted as a social conservative for years, but last night said" It is unconscionable that any one in the richest country in history has to pay for health care or higher education. And I don't see why we haven't done something to get free of that damned foreign oil. And I don't think one more American boy should die for oil!" The thing is, he starts to draw Social Security in a couple of months, and there isn't a defined benefits pension plan any more so he really needs SS to be solvent so he can make it, and he sees privatization as his own road to ruin.
